1. Acceptance and incorporated policies

This Site is operated by Nisbat Industries, LLC DBA ShearStore.com (“ShearStore.com”, “we” or “us”). By using this Site or purchasing from ShearStore.com, you agree to these Terms and Conditions of Use (“Terms”). These Terms incorporate by reference our Privacy Policy, Shipping Policy and Return Policy. Please also review any product-specific information and the terms presented at checkout, which apply together with these Terms.

2. Orders and order acceptance

Submitting an order is an offer to purchase, not a completed sale. An automated order-confirmation email confirms we received your order; it does not necessarily mean the order has been finally accepted.

We may cancel an order before it is fulfilled for reasons that may include an inventory error, an obvious pricing or technical error, suspected fraud, inaccurate order information, or an inability to fulfill the order. If you have already paid for a cancelled order, we will refund it in full to your original payment method.

If a product is shown at a clearly incorrect price because of a technical or data-entry error, we may correct the error and cancel and fully refund the affected order before it ships. This does not give us a general right to cancel an order that was validly priced.

3. Prices, taxes and payment

Prices are shown in the currency presented at checkout. Applicable taxes and any optional shipping charges are shown during checkout. Payments are processed through Shopify’s checkout and its payment providers; ShearStore.com remains the seller of the products you purchase through the Site. By placing an order, you confirm that you are authorized to use the payment method you provide.

4. Inventory and availability

Occasionally an item may become unavailable after you order it. If that happens, we will notify you and refund the unavailable item in full, including any shipping charged for it, to your original payment method. If you would like a different model, we will direct you to place a new order through our secure checkout rather than handling payment card details by email.

5. Fraud and order verification

By placing an order, you confirm that the information you provide is accurate and complete. We may contact you to verify order details we reasonably need to fulfil your order. We may hold or cancel an order, and may decline future orders, where we reasonably believe there is a fraud or security concern, inaccurate order information, or a breach of these Terms.

6. Intellectual property

The content, organization, graphics, design and other materials on the Site are protected under applicable copyright, trademark and other intellectual-property laws. You may view, print or download Site content for your own personal, non-commercial use. Copying, republishing, redistributing or otherwise commercially using Site content without our permission is prohibited. Using the Site does not give you ownership of any content on it.

7. Acceptable use

When using the Site, you agree not to: commit or attempt fraud; introduce malicious code; interfere with the Site, checkout, accounts or security systems; access any part of the Site without authorization; use automated scraping or other automated activity that places an unreasonable burden on the Site; or use the Site for any unlawful purpose.

8. Product information and care guidance

Product and Site information may change. Care guidance on the Site, including the Essential Care page, is general maintenance advice. It does not guarantee a particular product lifespan and does not create a warranty.

9. Shipping, returns and refunds

Shipping is described in our Shipping Policy. Returns, refunds and defective, damaged or incorrect items are described in our Return Policy. Both are incorporated into these Terms by reference; we do not repeat their detailed terms here.

10. Third-party services and links

Shopify and other service providers supply checkout, payment and other supporting services used by the Site. Their own terms and privacy practices apply to your use of those services.

The Site may also link to other websites. Those sites have their own terms and privacy practices, and we are not responsible for their content or operation.

11. Privacy

Our Privacy Policy explains what information we collect, how we use it, and your choices, and is incorporated into these Terms by reference.

12. Feedback

If you voluntarily send us feedback, suggestions or ideas, you give ShearStore.com a non-exclusive, royalty-free permission to use them to operate and improve the store and its products and services, without obligation to you. You keep ownership of any photos, reviews or other content you create, unless we separately agree otherwise in writing.

13. Disclaimer and limitation of liability

Nothing in these Terms limits any right or remedy you have under applicable law that cannot legally be limited or waived, including your rights and remedies under applicable consumer-protection and product-liability law.

Subject to that, and to the extent permitted by law, ShearStore.com and its affiliates are not liable for indirect, special, incidental or consequential damages, including loss of business or profits, arising from your use of the Site or of products purchased through it.

14. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, subject to any consumer-protection laws that apply to you.

We may update these Terms from time to time. The current version and its “Last updated” date are posted on the Site.
